Client (Parent/Carer) Agreement

TERMS & CONDITIONS​

 

1. INTRODUCTION

1.1. The use of the words ‘Synthesis Education, ‘we’, ‘our’ and ‘us’ refer to Synthesis Education and its employees. The words ‘client’, ‘parent’, ‘carer’, ‘you’ and ‘your’ refer to whoever is reading this or is making use of our services

1.2. The term ‘tutoring’ refers to any tutoring services provided by Synthesis Education either online, at a client’s residence or any other agreed location

 

2. TUTORS

2.1. The Synthesis Education tutors are qualified teachers, lecturers, those studying to become a teacher, or are high achieving in their chosen ATAR subjects

2.2. Our tutors are bound by the Tutor Code of Conduct as set by the Australian Tutoring Association

 

3. BOOKING A TUTOR

3.1. You can book by calling 0438 399 887, by visiting www.synthesiseducation.com.au, or by searching for Synthesis Education on social media platforms

 

4. COMMENCING TUTORING

4.1. FACE TO FACE TUTORING

4.1.1. Subject to availability and agreement between you and the tutor, sessions can be scheduled for a suitable time, day or place, including your home, workplace, library, or similar locations.

4.1.2. A parent or other responsible adult must always be at the agreed tutoring location during a tutoring session for any student under the age of 18 years. Please note, we are not authorised to transport students

4.1.3. After each tutoring session, the tutor may ask you to verify your attendance. This may be done online or in hard copy. You will receive a copy of the tutor’s session via a report in TutorCruncher

4.1.4. You must provide and maintain a safe working environment for our tutor whenever they are in attendance

4.1.5. Bullying and harassment in any form by any client, client representative, student, tutor or the associates of any of these is not acceptable and will not be tolerated. Incidents of bullying or harassment should be reported immediately to Synthesis Education

4.1.6. Synthesis Education is committed to providing a safe and professional level of tutoring for all students. As members of the Australian Tutoring Association, we abide by the ATA Code of Conduct, the ATA Conflicts and Complaints Resolution Procedure, and the ATA Child Protection Principles

4.2. ONLINE TUTORING

4.2.1. Subject to availability and agreement between you and the tutor, sessions can be scheduled for a suitable time

4.2.2. A parent or other responsible adult must always be within hearing distance during an online tutoring session for any student

 

5. REQUIRED NUMBER OF TUTORING SESSIONS

5.1. To gain the maximum benefit from tutoring, we recommend (1) or (2) sessions per week with your tutor during the school term. Tutoring over school holidays may be available by consultation with your tutor

5.2. No minimum number of tutoring sessions is required except where you have purchased a Tutoring Package for a specific number of sessions

 

6. TUTORING SESSION DURATION AND RATES

6.1. The length and cost of a 1 to 1 tutoring session varies depending on tutor qualifications and experience, and difficulty of subjects:

6.2.1. 45 minutes of tutoring - $35-$70

6.2.2. 60 minutes (1 hour) of tutoring - $50-$140

6.2.3. 90 minutes (1.5 hour) of tutoring - $200 (generally for QCE and tertiary subjects)

6.2.4. 120 minutes (2 hours) of tutoring - $250 (generally for QCE and tertiary subjects)

6.3. For the comfort of the student and tutor, tutoring sessions of more than (60) minutes must have brief rest breaks factored in

 

7. CONFIDENTIALITY

7.1.  In this paragraph:

‘Damage’ means both economic loss, loss of reputation and damage to reputation, work or professional standing

‘Personal Information’ means any information about, or in connection with, this agreement

7.2. The Tutor and Client acknowledge that neither will:

  1. divulge to any person any Personal Information relating to the other, which they learn as a result of this contract or any circumstance flowing from the contract;

  2. post any text, image, or audio-visual material, on any social network or other public place which could be hurtful, embarrassing or damaging to the other of us

7.3. The Tutor and Client agrees that any Damage arising directly or indirectly from a breach of the above provisions must be compensated on the basis of the effect on the damaged party

7.4. The Client accepts personal liability for compliance with these provisions by members of their family and domestic staff and the Tutor accepts personal liability for compliance by any employee

7.5. No matter how this contract ends, this paragraph shall be effective for (7) years from today.

 

8. CHANGES IN SESSION TIME/CANCELLATIONS

8.1. To change or cancel a session due to illness, school commitments, specialist appointments etc., please advise your tutor as early as possible. We require a minimum of (24) hours notice of changes to your session

8.2. If you fail to give the required notice, Synthesis Education may, at our discretion and without further notice, submit the scheduled session as completed. Your session will be treated as ‘missed’ (see below)

 

9. LATE FOR TUTORING

9.1. If you are going to be late for a tutoring session, please telephone your tutor. If a student is more than 15 minutes late without explanation, the session will be treated as ‘missed’ (see below).

 

10. MISSED SESSIONS

10.1. ONE TO ONE TUTORING

10.1.1. If a minimum of 24 hours notice is given for a cancellation, you will not be charged. Your tutor may, at their discretion and subject to their availability, offer to re-schedule the session for you

10.1.2. If a minimum of 24 hours notice is not given for a cancellation, or a session is cut short by illness or emergency, you may forfeit the session, at the tutor’s complete discretion, and incur the cost of the missed scheduled tutoring session

10.2. TUTORING PACKAGES

10.2.1. Tutoring Packages require payment in advance and are structured to be used within time limits. All tutoring sessions must be taken within the time limits specified for the purchased Tutoring Package. Tutoring Packages cannot be extended and no refunds will be given where a client cancels scheduled tutoring sessions and the time limit applicable to the purchased Tutoring Package subsequently expires. Missed or otherwise unused hours remaining after the expiry of your Tutoring Package will be lost

10.2.2. When a minimum of 24 hours notice is provided for a session cancellation, your tutor may, at their complete discretion and subject to their availability, offer to re-schedule the session for you within the time limits of your Tutoring Package. A rescheduled session cannot, however, be guaranteed

10.2.3. When a minimum of 24 hours notice is not provided for a session cancellation, your tutor is not required to reschedule the missed session

 

11. EXTENDED ABSENCE

11.1. If you miss more than two consecutive tutoring sessions without explanation, Synthesis Education may terminate your enrolment

11.2. If you have pre-purchased a Tutoring Package, you will not be refunded for the missed sessions, however we will refund the balance for the remaining unused sessions

 

12. TUTOR ABSENCE

12.1. If your tutor is absent and has not contacted you, please attempt to contact them. You will not be charged for any absence by a tutor

 

13. TERMINATION OF TUTORING

13.1. You may terminate tutoring at any time by notifying us in person, by electronic means or by telephone the amount of notice in 13.2.

13.2. The amount of notice required when terminating tutoring is (7) days. This also applies to pre-paid tutoring packages

 

14. TUTORING FEES

14.1. See Section 6 for information on Tutoring Rates

14.2. Once tutoring commences, we consider all scheduled tutoring sessions to be firm bookings and normal fees and charges apply

14.3. If you have purchased a Tutoring Package, we will invoice you for the total cost of the Package in advance, which you may pay either as a lump sum or by regular instalments using the payment methods available

 

15. PAYMENT OF FEES

15.1. By engaging our tutor, you agree to pay for all scheduled tutoring sessions

15.2. You will not have to pay for a scheduled tutoring session if the tutor is unable to attend or is, in some other way unable to provide the service

15.3. You will not have to pay for missed tutoring under Section 10.1 where you and the tutor have agreed to cancel a session, or where you cancel a tutoring session having given the amount of notice required

15.4. You will not have to pay for missed tutoring under Section 10.2 where the tutor or Synthesis Education, for reasons other than the effects of cancellations by you, have been unable to complete your Tutoring Package within its advertised time limit. If we or our tutor are not able to complete your Tutoring Package within the advertised time, we will, at our discretion, either extend the time limit of your Tutoring Package or refund any unused pre-paid tutoring sessions

15.5. If you have purchased a Tutoring Package for a fixed number of sessions and you terminate tutoring before completing the package, any tutoring sessions that you have not used will be refunded

15.6. All tutoring fees must be paid within 7 days of Invoice.

15.7. Our preferred payment methods are listed in TutorCruncher

15.8. An invoice will be emailed to you following each tutoring session and you will be emailed a receipt when payment has cleared

15.9. Overdue and unpaid fees will be handled in accordance with Section 16

 

16. NON-PAYMENT

16.1. All tutoring accounts are payable within seven (7) days of invoice. Overdue accounts may be subject to Late Payment Fees

16.1.1. If after seven (7) days, a payment has not been made, a late payment fee may be added per week, until payment is made

16.2. If you do not pay your tutoring account, we may also suspend your tutoring until your account is paid

16.3. If we suspend your tutoring and you do not pay your account within (14) days, we may terminate your tutoring without further notice

16.4. Accounts that remain outstanding 30 days from invoice will be referred to our collection agent for recovery. Any additional costs incurred by us in the recovery of your fees will be added to your account to the extent permitted by law

 

17. REFUNDS POLICY

17.1. Except for pre-paid tutoring packages, tutoring is generally billed to and paid for by the client after tutoring has taken place.

17.2. Please notify us immediately if you become aware of any dispute or discrepancy in relation to our tutor’s attendance, or standard of tutoring

17.3. All matters arising in 17.2 are governed by Section 22. You will not be required to pay for any matter under dispute until such time as the matter is resolved

17.4. You will not be entitled to a refund for any booked sessions if you do not give us the amount of notice required in Section 10 or 13

17.5. Tutoring Packs for a fixed number of sessions that are terminated early will be adjusted before any refund is given

 

18. ACCEPTANCE OF TERMS AND CONDITIONS

18.1. You have signified acceptance of these terms and conditions by utilising our services. You will be prompted should you be required to accept any terms not stated in these terms and conditions

 

19. CLIENT WARRANTIES, LIABILITIES AND UNDERTAKINGS

19.1. We aim to support students academically to the best of our ability. However, Synthesis Education does not accept responsibility for their performance in an examination or assessment

19.2. You agree to indemnify and hold us harmless from and against any claim brought against us by a third party resulting from the provision of services by us to you

 

20. CHANGES TO TERMS AND CONDITIONS

20.1. We may change the Terms and Conditions of this agreement at any time. Current Terms and Conditions will always be displayed on our website

 

21. CORRESPONDENCE

21.1. The normal means of us contacting you or you contacting us for invoicing and other official business will be by email, SMS or telephone

22. GRIEVANCES AND DISPUTES

22.1. All grievances and disputes arising from the services outlined in these terms and conditions will be handled in accordance with the Conflict Resolution Policy as set out by the Australian Tutoring Association
